A settlement of your workers’ compensation case is a negotiated agreement between you and your Employer/Carrier where they pay you a lump sum of money in exchange for their obligation to provide further workers’ compensation benefits to you.
In the Florida workers’ compensation system, settlements are not mandatory and neither you, nor the Employer/Carrier has an obligation to settle a case. Furthermore, the workers’ compensation Judge can decide disputes over benefits, but the Judge cannot order a settlement that has not been agreed to by both parties. (This is unlike personal injury cases where a lawsuit can result in a jury verdict or award for the value of the case.) Because settlements cannot be forced, having an attorney who has over 27 years of experience negotiating settlements, and who practices exclusively in this area of law, is of great value to you, the client. You need someone who can convince the Employer/Carrier through litigation or advocacy that it is in their best interest to pay you a reasonable settlement that you desire.
In most cases, settlement does make sense at some point in the case. However, some catastrophically injured workers’ or permanently incapable of returning to work, may wish to keep receiving ongoing benefits and keep their cases open. Knowing when the right time is to resolve a case, and for what amount of money, is a decision that you, the client, will make relying upon the advice and counsel of your attorney. It is also of great importance to manage the interplay between workers’ compensation benefits and Social Security disability, Medicare and long-term disability benefits.
