If benefits are not being appropriately provided in your case, claims can and should be brought to obtain the recommendation of the OWCP and then a final compensation order from an Administrative Law Judge (ALJ).  We begin by filing a Request for Intervention (LS-7) and preparing a detailed position paper requesting an informal conference before a Claims Examiner at the OWCP.   After the conference, a recommendation will be made regarding the issues in dispute.  If the Employer/Carrier does not timely comply with the recommendations, we then proceed with filing a Pre-Hearing Statement (LS-18) and demand a hearing with an ALJ at the Office of Administrative Law Judges within the  U.S. Department of Labor.

There are never any attorney’s fees or costs due from our clients up front for representation at OWCP or OALJ.  If we prevail and obtain any benefits that are in dispute, the Employer/Carrier have the legal obligation to pay for your attorney’s fees and costs.  You get the benefits in dispute and your attorney’s fees and costs are paid in addition to these benefits.
