When the Employer and their workers’ compensation insurance company (known collectively as the Employer/Carrier) fail, refuse, or deny benefits, the injured worker can file a workers’ compensation lawsuit known as a “petition for benefits.”  As your Florida workers’ compensation lawyer, we will aggressively fight to ensure you are receiving all the compensation and medical benefits you are entitled to under the law.  A petition for benefits can, and should, be filed over any benefit not provided. Throughout the life of a workers’ compensation case, multiple petitions may be filed if the Employer/Carrier is not providing the benefits they should.

After a petition is filed, the case will be scheduled for a mediation conference (within 130 days of the petition), pretrial conference, and a final hearing before a Judge of Compensation Claims (a judge that exclusively hears workers’ compensation trials).  As your attorney, we conduct investigation and discovery, take depositions of lay and expert witnesses, file procedural motions as necessary, and put together all the evidence necessary to win the case at trial before the Judge of Compensation Claims.  Alternatively, we put you in a position to settle the case for the maximum amount possible if this is your desire. 

What does it cost to hire a lawyer to litigate disputed issues under Florida workers’ compensation law? 

It does not cost anything out of your pocket, and we do not charge a retainer or any amounts up front.  You will never receive a bill for legal services from Just Comp, PLLC.  The law says that if we file a petition for benefits and the Employer/Carrier fails to provide the benefits requested within 30 days of the receipt of the petition for benefits, then they are responsible for paying your attorney’s fees and costs if they later agree to provide benefits or are ordered to provide benefits by the Judge of Compensation Claims.
